TERMS AND CONDITIONS
By making a payment to Primero Tours and Travel, you understand and agree to the Terms and Conditions and on behalf of the people in your group. You shall be responsible for all payment dues and it applies collectively to the group reservation not the individual.
- Reservations
1.1. A pencil booking/online registration does not guarantee your reservation. Confirmation is upon receipt of your reservation fee only.
1.2. Pencil bookings are held for three (3) business days and are automatically released if your reservation fee is unpaid unless we agreed with a different arrangement.
1.3. Seats are given strictly on a first come first served basis upon receipt of your reservation fee.
1.4. You and your travel companions must register individually for the trip, unless stated otherwise. For public group tours, we strictly enforce a No Register, No Ride Policy. Please ensure correct contact details are provided for each person. This will be used in sending you important trip information and generating passenger manifests. 1.5. Primero Tours and Travel reserves the right to cancel bookings when deemed necessary or if products and services (e.g. tourist transport and/or hotel unavailability, under occupancy of public group tours, etc.) are not available from our Providers (third party vendor and service provider).
1.6. Primero Tour and Travel’s services are available only to persons of legal age. You must have the right, authority and capacity to transact business and agree to abide by these Terms and Conditions.
1.7. If you are availing the services on behalf of another organization or entity, you agree to be bound by this agreement on behalf of the organization or entity you represent and warrant that you have the authority to bind the organization or entity to these Terms and Conditions.
- Terms of Payment
2.1. Reservation fees are non-refundable but can be transferred to a new person on the same tour and travel dates.
2.2. Upon receipt of your reservation fee, you will receive a payment acknowledgement via email.
2.3. Remaining balance must be fulfilled at least seven (7) business days prior to your date of travel. Your travel voucher will be emailed to you once full payment has been received. Official receipts will be provided on the trip upon departure. Failure to pay your remaining balance on your due date will cancel your reservation and forfeit all paid reservation fees. Rebooking your canceled reservation may be allowed if slots are still available however full payment will be required.
2.4. Late payment arrangements/flexi plans are available but subject to approval.
2.5. Credit card payments via Paypal are subject to a 5% service charge. Service charges for other remittance centers/apps may vary.
2.6. Check payments may be accepted for private and government organizations. Payments made by check are only considered paid until fully cleared and released for payment. Send bill arrangement is subject to approval.
- Prices
3.1. All rates and packages are based on current prices. It is subject to change without notice .
3.2. Prices listed are per person and guaranteed against any surcharge unless otherwise specified.
3.3. Price quotations are subject to change without notice.
3.4. Prices do not include tips/gratuities to drivers, tour coordinators or local guides; personal travel insurance; porter fees; and public restroom fees/donations.
3.5. Cancellation, refund and rebook are not applicable for discounted tours under a promotional campaign unless otherwise stated and if you are eligible for such in accordance with these Terms and Conditions.
3.6. Flash Sale promotional prices are not available on long weekends, holidays, special trips or private tours unless otherwise stated. Seats are allocated on a first come first served basis.
3.7. Flash Sale promotional prices will be forfeited and regular rates will apply if you (a) miss or extend your payment schedule and (b) reschedule your trip.
- Cancellations, Rescheduling and Refunds
4.1. Reservations may be rescheduled provided your request is made before its payment due date, however reservation fees will be forfeited.
4.2. If you cancel your trip at least fifteen (15) business days before the travel date, a partial refund (50% of the total balance paid less reservation fee) will be issued. Cancellations within fifteen (15) business days from your date of travel will not be entitled to any refund.
4.3. If you are on a pre-approved late payment arrangement/flexi plan, where a cancellation of one (1) or more persons under your group occurs within seven (7) business days from your date of travel, the full balance must be paid in order for your group to proceed.
4.4. You may transfer your reservation to a new person provided the same date/destination is availed.
4.5. In the case of public tour cancellations due to under occupancy, the following options will be offered to you:
4.5.1. Reschedule to a different date
4.5.2. Transfer to another available destination
4.5.3. Convert payment into a consumable travel fund (transferrable)
4.5.4. Full refund (not applicable for late payment arrangements / flexi plan)
4.6. In the case of private or public tour cancellations due to changes in weather and road conditions prior departure, the following options will be offered to you:
4.6.1. Reschedule to a different date
4.6.2. Transfer to another available destination
4.6.3. Convert payment into a consumable travel fund (transferrable)
4.7. Refunds will be processed within five to seven (5-7) business days from date of request. Refunds to BPI may take less processing time. Refunds to other banks may incur a service charge which will be deducted from the amount to be refunded.
4.8. Any unused tours, transport and paid activities during the duration of the tour are non-refundable. In the event of force majeure, you may be entitled for a refund/partial refund subject to Provider’s terms and conditions.
- Travel Funds
5.1. Travel funds are issued in the event of tour cancellations due to under occupancy, weather changes or road conditions.
5.2. All issued travel funds regardless of nature are consumable within 12 months of email confirmation unless stated otherwise.
5.3. Travel funds are non-refundable however transferrable to another person/s provided the headcount of the original reservation is maintained.
5.4. Travel funds can be used with any product/service provided by Primero Tours and Travel (subject to availability).
5.5. Upon rebooking a trip, you must ensure sufficient notice is provided to ensure seat availability.
- Itinerary & Time Management
6.1. Suggested itineraries are based on estimates of distances and travel times. It serves as a general guidance only and may not be based on the latest available information.
6.2. Itineraries are subject to change according to your group’s pace, weather changes and other circumstances whether foreseen or not.
6.3. Driver/tour coordinator/tour guide reserves the right to alter the itinerary if deemed necessary to serve the greater good. You must adhere to the time allocated for specified activities and must comply with set tour schedules.
6.4. Assigned land/sea travel departure schedules are strictly observed. In the case of public group tours, any guest who does not arrive on time or after the grace period given will not be accommodated nor be refunded of his/her payment.
6.5. If you are flying in/out of Manila before/after your travel date, please coordinate with your assigned travel adviser to ensure flight schedules are in accordance with your land travel itinerary. We shall not be liable nor responsible for any additional and incidental expenses incurred due to delays or cancellations of your flight.
- Covid-19 Travel Requirements
7.1. Travel requirements are subject to change at short notice by the issuing government authority. As such, posting of the advisories in either our website or social media accounts is not real-time and serves only as your guide. You may either confirm applicable requirements with us or directly with the offices/websites of their place of origin and destination.
7.2. If your travel destination requires Covid-19 testing whether Reverse Transcription Polymerase Chain Reaction (RT-PCR) or Rapid Antigen Test (RAT), we require you to perform such tests from our point of origin prior to departure.
7.3. If you opt to perform the required testing at the border of entry of your destination, we shall not be responsible nor liable for any delay, damage, loss or sickness that may arise should you or anyone else traveling with you receive an unfavorable result.
7.4. All other guests, including the driver and other service personnel that belong to the same group/vehicle, will be denied entry and will be escorted back to their point of origin. We will not refund any amount nor bear any expense that may arise from such circumstances.
- Conditions of Provider
8.1. The provision of transportation, accommodation and tour guide services is subject to the Provider’s terms of service. They reserve the right in their absolute discretion to terminate your travel arrangements should your behavior be, such that it is likely in our opinion, in violation of any applicable governing laws, to cause distress, damage, annoyance or danger to other guests, service personnel or any other person. In such circumstances, you will not be entitled for any refund or compensation, if applicable.
8.2. Our Providers reserve the right to deny service if you are causing potential harm and distress to fellow guests, service personnel or other persons. Primero Tours and Travel limits its liability for any incident of similar nature between you and our Provider.
8.3. Additional charges which may result from your requests such as alternative pick up/drop off location, room transfers and tour upgrades that may alter the agreed services between Primero Tours and Travel and its Providers will be at your expense.
- Child Policy
9.1. If you are traveling with young children (12 years of age and below), please note child seats are not provided for transfers.
9.2. For public tour packages, all children are considered as one (1) person, and will be charged accordingly. Riding for free on parents lap is not allowed for safety reasons.
9.3. For private tours, children may join the trip free of charge provided that they share a bed/seat with their parents. No provisions will be made for them in terms of bed allocation/food and entrance/environmental/tourist registration fees.
- Senior Citizens, Persons With Disability and Persons With Medical Concerns
10.1. If you or one of your travel companions is a Senior Citizen/Person w/ Disability/Person w/ Medical Concerns, please coordinate with Primero Tours and Travel prior booking. This is to ensure that we will be able to choose Providers who are equipped with proper disability aids and can offer tours/activities suitable for you/travel companion. We shall assume no responsibility for any inconvenience in this regard if we are not informed.
10.2. If cleared to travel/participate in the tour, a valid Senior ID/PWD ID must be presented to avail certain privileges such as priority lane, seat designation and room allocation.
10.3. With regards to medical status and physical capability, it is your responsibility to decide whether the tour/activity you are availing is suitable for you and your travel companions. We shall assume no responsibility for any incurred expenses related to medicines or medical care that might occur during your trip.
- Force Majeure
11.1. Force majeure events refer to any unforeseeable circumstances which are beyond our control, or any unavoidable event, even if foreseeable, as a result of which we are unable to perform our obligations, in whole or in part, under these Terms and Conditions. Such circumstances include, but not limited to, acts of God (e.g. natural catastrophes, adverse weather conditions, earthquakes, floods, fire, etc.), mechanical issues with transportation, breakdown of equipment, cancellation and delays of airlines, failure of electrical lines and water supply, accidents, war or threat of war, acts of terrorism, riot, insurgence, radiation epidemic, pandemic, quarantine, civil commotion, governmental acts and emergency declarations, state of emergency or any other similar event.
11.2. If we are unable to perform our obligations , in whole or in part, due to force majeure, these Terms and Conditions are automatically terminated and we are both relieved from future obligations. We shall notify you of the scope of force majeure through any available means of communication within 14 days and shall take reasonable actions to mitigate the damages.
- Limitation of Liability
12.1. Primero Tours and Travel acts in good faith, acting as an intermediary and agent for our Providers and as such, we shall not be responsible nor liable for breach of contract or any intentional or careless actions or omissions on part of our Provider, which may result in any delay, damage, loss, injury, death, sickness or accident that you may sustain in the course of availing the indicated services.
12.2. Primero Tours and Travel shall not be responsible nor liable for any delay, damage, loss, injury, death, sickness or accident that you may sustain in connection to acts of God (e.g. natural catastrophes, adverse weather conditions, earthquakes, floods, fire, etc.), mechanical issues with transportation, breakdown of equipment, cancellation and delays of airlines, failure of electrical lines and water supply, accidents, war or threat of war, acts of terrorism, riot, insurgence, radiation epidemic, pandemic, quarantine, civil commotion, governmental acts and emergency declarations, state of emergency or any other similar event.
12.3. Primero Tours and Travel does not warrant that travel to destinations it offers is risk free and as such, we are not liable for any delay, damage, loss, injury, death, sickness or accident caused by travel to such destinations.
12.4. If, despite the limitation above, we are found liable for any delay, damage, loss, injury or death, such liability is limited to, whichever is lower, either the service fee paid to us in connection with the subject transaction or Ten Thousand Pesos (Php 10,000.00).
12.5 The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms and Conditions is found to have failed of its essential purpose. The limitations of liability provided in these Terms and Conditions inure to the benefit of Primero Tours and Travel.
- Termination
13.1. Primero Tours and Travel reserves the right to modify, revise or update these Terms and Conditions from time to time, in whole or in part, without notice. You should review these policies from time to time to stay abreast of changes.
- Governing Law
14.1. Primero Tours and Travel operates from the Republic of the Philippines. Its laws shall govern the interpretation and enforcement of these Terms and Conditions.
